New Mexico Additional Rental Terms

This Property is managed by a professional Property Manager and all Bookings are subject to these additional terms and conditions, which are incorporated in the Rental Agreement by reference.

Refunds & Cancellations:

This property allows no refunds for cancellations received within sixty (60) days of check-in due to the longer advanced bookings generally received in New Mexico, except in the case where the property is re-booked under the same terms.

Interruption in services within the Property and/or inclement weather during the Reservation Dates shall not serve to void or cancel the Rental Agreement or any portion thereof. Guest acknowledges and understands that RedAwning.com, the Property Owner and Property Manager are not responsible for acts of God, such as hurricanes and other disasters, or for other lesser acts of God, such as bad weather. No refunds shall be made to a Guest by reason of the above.

Checkout is at 10AM:
The checkout time for this property is 10AM to allow additional cleaning time between rentals.

Age Restrictions:
You may not assign this agreement nor sublet this Property. Further, Manager does not rent to non-family groups unless all members are 25 years of age or older. If Manager determines
at check-in or thereafter that Guests do not meet the specified age requirements, the Rental Agreement is breached and the Guests will be denied access to the property or
subject to eviction without refund.  Exceeding the maximum occupancy will incur similar penalties.

Santa Fe Noise Ordinance:
For Santa Fe guests only (not applicable to any Taos or Angel Fire guests): Pursuant to Santa Fe City Ordinance 2009-40, no outdoor activity is allowed beyond
10pm. This includes decks, portals, porches, balconies, yards or patios. You shall not violate any laws while occupying the property. Likewise, you will subject your Guests and
Invitees to the same rules and regulations that you agree to herewith.

Arbitration Addendum:
In the event of a dispute between the parties arising out of or relating to this Agreement, including with respect to any Bookings or sums billed, collected and/or distributed hereunder, the parties shall first attempt to resolve the dispute through informal good faith negotiations entered into promptly upon the request of a party. In connection with such process, each party shall share all information relating to such matter reasonably requested by the other party. In the event such dispute is not successfully resolved within 30 days of the parties’ initial dispute resolution conversation, the matter shall be submitted to binding arbitration for resolution. Such arbitration shall be conducted by the Santa Fe, NM Judicial Arbitration and Mediation Services, or its successor (“JAMS”). Arbitration shall be conducted by JAMS in accordance with applicable JAMS rules governing the resolution of commercial disputes, generally, provided that notwithstanding any contrary provision within the JAMS rules, the arbitrator shall determine the rights and obligations of the parties according to the substantive laws of the state of New Mexico. The parties shall share equally in the cost of the arbitration subject to the arbitrator’s discretion to allocate such cost among the parties in accordance with equitable considerations. Any award, which may include legal and equitable relief, will be final and binding and judgment may be enforced by any court of competent jurisdiction.
